Southern California Supplemental Security Income Lawyers
Supplemental Security Income or SSI is a benefit program for disabled, low-income people who are not covered by Social Security. You may also be entitled to SSI if your Social Security benefits are below a certain minimum level.
At the law firm of Judith S. Leland, our lawyers help people obtain SSI benefits in Southern California. We represent clients at all stages of the claims process, from initial application, to reconsideration, hearing and appeals. We offer a free initial consultation and convenient office locations in Downey, Santa Ana and Ontario.
A Needs-Based Disability Program
You do not have to have paid into the Social Security program to be eligible for Supplemental Security Income or SSI. Your monthly benefits are based solely on need.
Since SSI is a needs-based program, your family assets and income must be limited. Special rules apply for legal residents who are not citizens. If anyone contributes to your support, that amount of support will be deducted from your benefit. However, there are certain instances where you can be the beneficiary of a special needs trust without reducing your SSI benefits.
SSI beneficiaries are entitled to Medi-Cal benefits. These benefits are similar to Medicare benefits, but may be more restrictive in terms of medical providers and may cover items which are excluded from Medicare coverage. Medi-Cal benefits are available from the first month you are entitled to SSI benefits.
Definition of Disability
The definition of disability is the same as that for Social Security Disability. You must have physical or mental problems (or a combination of problems) severe enough to keep you from substantial gainful activity for at least 12 months.
